News Release: Somach Simmons & Dunn Prevails in Federal Court Challenge of Land Exchange

On April 7, 2009, Somach, Simmons & Dunn (SSD) and the United States prevailed in the United States District Court for the Eastern District of California, in defending their clients against a challenge under the National Environmental Policy Act (NEPA) and the Federal Land Policy Management Act (FLMPA). Plaintiffs in the case challenged a land exchange between the Bureau of Land Management (BLM) and the private parties represented by SSD attorneys Sandra K. Dunn and Jonathan R. Schutz.

On January 7, 2009, Stuart Somach argued before the California Supreme Court in the matter of Morongo Band of Mission Indians v. State Water Resources Control Board, California Supreme Court Case No. S155589. The Justices of the Supreme Court appeared skeptical of the Court of Appeal's decision, which held that a State Water Resources Control Board staff attorney could not simultaneously prosecute a matter before the Board while also advising the Board, even in an unrelated matter. Justices Kennard and Corrigan expressed the most concern over the lower court ruling.

November 2008
On November 7, 2008, the Glenn County Superior Court issued its judgment upholding the CEQA review performed by GCID and two cooperating water districts for a groundwater testing project. The Court upheld all aspects of GCID's environmental review and denied the lawsuit in its entirety.
